Have you decided to take the leap into entrepreneurship and start your own business? It is a very exciting time but first check if you need a business licence or you might find yourself on the wrong side of the law instead of making a profit.

What is a business licence?

In short, this is a document that allows you to do business in a specific area. In order for you to obtain such a document you need to comply with all the building, health and safety, and public regulations.

If I buy an existing business, do I still have to apply for a licence?

Yes.  These documents are non-transferable, which means that even when you take over a business you need to apply for your own licence.

Which type of business needs a licence?

Although not all businesses need one, there are certain establishments that do need a licence in order to operate. These are:

  • Health clinics, spas, saunas, and public baths
  • Massage parlours, laser and ultraviolet treatment centres
  • Escort agencies and adult shops
  • Cinemas and arcades
  • Nightclubs and pool rooms
  • Any business with three or more vending or slot machines
  • Hawkers
  • Places that sell food and/or liquor, provide take-aways or transport meals

How does the application process work?

You need to complete an application form and then submit it together with the applicable documentation to the relevant licensing department. Once your application is received, the department will send a report to the necessary municipal departments to ensure that the application meets the required legislation.
